Business Insider reports that law and accounting “see especially high demand” from AI data buyers.5 micro1 lists “Finance & accounting: financial processes, SOPs, reconciliations, approvals, reporting workflows, and operational documentation” among the data it seeks.4
The hard line: tax return information
Section 7216 makes it a misdemeanor for anyone in the business of preparing returns to knowingly or recklessly disclose information furnished for a return, or use it for any other purpose.1 The Treasury rule says a preparer “may not disclose or use a taxpayer's tax return information prior to obtaining a written consent,” that consent “must be knowing and voluntary,” and that conditioning services on consent generally makes it involuntary.2
“A tax return preparer may not disclose or use a taxpayer's tax return information prior to obtaining a written consent from the taxpayer, as described in this section.”26 C.F.R. § 301.7216-3(a)(1)2
Client financial data can also fall under the GLBA, and Frankfurt Kurnit lists payroll and tax records and data from regulated systems among the material to exclude entirely, rather than rely on de-identification.3 Professional standards and state board rules on client confidentiality may also apply.
What an accounting firm can realistically scope
| Usually in scope (firm-owned, after review) | Usually excluded |
|---|---|
| Engagement SOPs and checklists with no client data | Tax returns and anything furnished to prepare them |
| Reconciliation, approval and review workflows | Client financial statements, ledgers and bank data |
| Reporting templates and internal training material | Payroll, HR and personnel records |
| Firm knowledge-base and QA procedures | Anything covered by client confidentiality terms |
Scope examples are drawn from micro1's published data categories4 and Frankfurt Kurnit's recommended exclusions.3 They aren't legal or tax advice. Have counsel review your scope.
Firm size
micro1 publishes a 30+ employee minimum.4 Some buyers accept smaller accounting firms. The fit check applies each buyer's size rule and routes you to the one that fits.
FAQ
Can a CPA firm sell client tax data to AI companies?
Not without meeting Section 7216. Disclosing tax return information without a written, knowing and voluntary taxpayer consent can be a federal misdemeanor, so most firms keep client tax information out of scope.
What accounting firm data do AI buyers want?
Process material that shows how accounting work gets done. micro1, for example, lists financial processes, SOPs, reconciliations, approvals, reporting workflows and operational documentation.
Does de-identifying client data solve the problem?
Not on its own. Frankfurt Kurnit recommends excluding payroll and tax records and regulated-system data entirely rather than relying on de-identification. Get advice on Section 7216 before licensing anything client-derived.
Is our firm too small?
Maybe not. micro1 asks for 30+ employees, but some buyers accept smaller accounting firms. The fit check routes you based on size, location and role.
